Beyond the fact that Nintendo will very likely take this down if they discover it using Flash as their platform is a bad idea considering that Flash is essentially discontinued and will be practically dead in two years.

On top of what James said, he is trying to SELL Nintendo’s work. Nintendo takes down fan content that doesn’t make a dime. There is no way it won’t get taken down. Also a lot of sites let you play games in your browser via a built in emulator. You could easily find one for EB.

But yeah, they’ve shown no progress, and are already charging money. That’s a big red flag right off the bat.
